As the topic states, is it legal IF you have not had any drinks and are drinking an open can/bottle and are off your P's? This is not a smart topic, saying how drink driving is good or anything just if you have one in the car is it legal.
No lectures pls

i assume it would be from a drink driving perspective, so long as your blood alcohol level is legal
this will require a blood test (at the station), as blowing into the meter will give a very high reading, due to the alcohol in your mouth.
i believe there is a law regarding driving with both hands on the steering wheel (except when changing gears etc.) you may find it's classed as negligent driving, regardless of whether it's beer or coke.

umm i think its illegal in most or all the states to have opened alcohol containers in the car.
hence your mates aren't supposed to be drinking booze even if ur sober and driving.
of course you could just throw them out the window if cops happened to pull u over, but watch for the littering fine as well then

Not so much of a drink driving thing, but you aren't meant to have your hands off the steering wheel. It was only the other day there was something in the paper about someone getting a fine for opening up a subway roll, and they hadn't even gotten to eat it yet. So aside from any alcohol laws, you'll not allowed to eat or drink whilst driving, otherwise your a bloody idiot

Took the plunge and rang the cop shop. Nice bloke their told me that it was NOT illegal to drink whilst driving IF your under .05 He did mention though that your breath will show a high reading which will mean a visit to the cop shop to clear it up.

usually when they breath test they ask have you had a drink in past 30mins, otherwise reading will be sky high due to alcohol in mouth.

Dunno about Vic, but I’m in QLD, and not too long ago a mate of mine got fined for sitting in the passenger seat of someone else’s car, in a car park with a open stubby.
Next thing you know, $150 fine

I think this needs to be cleared up, im not exactly sure, but is it or is it not illegal to be a passanger in a car with an open drink, some ppl have said it is (most) but you said you rang the cop shop and they said you could?????
I just wanna know for future reference, otherwise i will be a bit more wary with the roadies or travelers as some may call them.

I've been told by a cop that passengers can drink, but the driver cannot, even if they are under .05.
I am pretty sure cops just make whatever they feel like atthe time... The most accurate way to find out would be to look up the legislation relating to drink driving.
