Got a $200 fine, for supposedly having my stereo on too loud, when me and da boiz were at the beach having a chat at nite. It was loud enough, so u can still have a conversation, so not that loud. And the pigs said sum rule about, if he can hear the stez 20m away he can book u., but you can anything 20m away at night, as its quiet... anything i can do?

At night the law changes. They would have given you the same fine if you were movering or had the edge trimmer out. They have been a little bit bias because it was a stereo.

hrmz..alrite then.. farinuff... but i do think the fine was a bit much though... and i dun even know, if i got any demerrit points taken off... from memory it was $150 fine and 1 point?

I know in NSW Its only a $150 fine and NO points!
I was talking to 2 cops a week ago that liked my stezza and were talking about them and he told me if he is beside me and can hear it in hes car then he would give them a fine $150 and no points!

Thats in NSW tho!

Firstly, the thread title is a bit extreme dont you think? There are anti-noise laws relating to stereos now that everyone knows about. Yes they can be extreme but just try and turn it down if you see cops near by.

Not sure how it is in Vic, but its usually down to officer discretion. So not much can be done.

Surely if they've given you the fine....you have a slip of paper with the details of that fine on it? That should tell you if you lost any demerit points?

That's how they do it in TAS anyhow....

it would be on the little piece of paper that they give u ....(the infringment notice)....err afaik vic doesnt take off points for too loud noise....

i thought they were going to do that sorta stuff in nsw though?

Yeh, well the slip says nothing about demerit points - which is good i think, but they wrote it out as a traffic infrigement, instead of a local laws/council infringement..

A traffic infringment car have points taken away depending on the rule broken,
A local law/ council law wont, as if i have a lawn mower at night going loud i cant have points taken off ma licance, for using a lawnmower.

yeh, dats where i dun understand. If i did commit a traffic offence, they didn't say how many points were taken. I'm guessing its a mistake. But i mite have to give vicroads a call to clarify it.

Ok. I'm about to get something off my chest, and I'm sorry that it had to be in your thread! I'm sick of people coming onto here and paying out cops. And just for the record, I have no relatives, no friends, no pets that are in the police force.

It is a fact of life that sometimes, people are going to be absolute pricks. It doesn't happen in just the police force. You work one day in a law firm or an accounting office and you'll know what I'm talking about. Every day I have to deal with people that think that they know better than you.

But the best way of dealing with a tricky situation is all in the way that you handle it. Police officers have a tricky job to do. Yes I will concede that sometimes they can be rather picky. Here's a good example. The latest edition of the Autosalon has an excellent article that puts a police officer up against some owners of modified cars in order to determine what aspects of there car, in its current form, would be defectable. On nearly every occasion, the police officer justified his comments. So it is my belief that for the majority of the time, the police officer will most likely know what he is talking about.

Now there is a fine line between being a smart **** and playing the situation cool when it happens. Did you even stop to think to ask the police officer under which regulation he is charging you under. There is no harm in doing this, and therefore, he will have to prove his authority to do the same. At least if you do this, you will know exactly what you have done wrong, and instead of coming on here and whinging, you can look up the relevant legislation (which is freely available on the net) and determing whether YOU think that the police officer was acting within his defined powers. If YOU don't think that he was, then you can take the appropriate action, like lodge a complaint at the relevant police station or prepare a statement etc. if you are required to go to court, outlining your problems with the way in which the matter was handled by the police officer.

There is a logical step in everything that you do, and you will find that if you do it right, and you know that you weren't necessarily in the wrong, then you will escape punishment. The wrong thing to do is whinge and moan to (a) the cops and (b) other people about police officers. If you have a problem with what has eventuated, take it up with them but do it in way that is not going to make the police officer want to fine you larger amounts and pick on you more! Sorry for my whinge, but like I said, I am just a bit sick of people paying out cops when they have probably one of the hardest jobs in Australia, that is, to try and please everybody. If you sit back and reflect, you will find that this won't happen in any job at all!
