okies here is the story...
my friend's car got stolen. lucky they got insurance. after 5 weeks if the car is not found they get the agreed value of the car from insurance company.
on the way home driving along back streets we spotted their car parked on the street!!! we came back a few nights in a row to find the car on the street again but in different parking spots (so it is obviously in use)
i know we should be reporting to the police that we found it. but they don't want to. if the police get the car... they will just return it. NRMA will pay for the repairs. but they would rather just get the agreed value. can't really blame them after seeing the state of their car now. even after repairs it just won't be the same.
so after they get the cheque from insurance company what do you think should be done? (excusing the slightly unethical choice of actions)
if we reported this to the police... would they acutally stake out and wait for the thief to use the car again and catch them in the act?

if the time has passed and you have the agreed value for the car, if it was recovered now it would belong to the insurance company who would auction it...
wouldnt it?
also, in order to stop these ****s doing it again, i say dob them into the cops and **** them up. i think you owe it to anyone who has had a car stolen, and anyone who owns a car. scum like this should be taught not to pull **** like it again, by a big bloke in jail named bubba!

After the insurance company has paid for the car property passes and it becomes their responsibility.
However, it would also be in your/your mate's best interest for this guy/s to get caught quickly, cos they are more than likely to get your next car that comes along.
Also keep in mind, your friend has a duty to the insurance company to report all information to his knowledge relevant to the claim. If he doesn't, and they later find out, they can reject his claim, or seek remedies against him.

steal it back, have a drunken weekend of speeding, paddock bashing & car wrecking crash it, dump it & throw a match in it...

after you go round and slowly torture them for a few days tie them up in the boot and drive to the cop shop (when you get the $$$ ofcourse)
But before you do that, you have my permission to snake anything and everything from them that you feel is worth more than $5!

But seriously, you shoud report it to the cops and insurance company as soon as possible.

i know that they should be reporting... but the car is thrashed.
think about it, if your car was thrashed around by some stranger and had damage, who knows what they have done in it, would you really want it back yourself? wouldn't you rather just buy another car?
we really want the thief to be caught. but i don't think the police would be bothered. they'll just pat themselves on the back cos the car was recovered and leave it at that.

Why not ask them if they would care / do something? You're right, I wouldn't want it back either but your insurance is a contract. Would you like it if they backed out on paying up because they didn't want to pay up?

stake the car out, find out where the theives live
and then when they are not home, break in and set their house on fire, making sure you burn **** like family albums, antiques and ornaments first.

I'd say find out where they live, then just make their life hell, like throw a brick at their window, puncture their real cars tires, just wreck the place really,

haha yeah all that stuff would be fun. but thief stole the car from their garage(so he would know where my mate lives) so might not be that great an idea
the insurance contract is in my mate's parents name... so the parents don't know about our find... so they aren't breaching contract. there is no contract between my mate and insurance company so he doesn't have to do anything
insurance company pays in a week or so, guess we have to wait till then atleast.

Err, not quite true. His parents would have constructive knowledge imputed through the knowledge by their son as common driver of the car. And its not really breach of contract, more like breach of duty of good faith that arises from the insurance relationship. All technicalities though
I'm sure you and your friend cannot absolutely confirm for sure that is his car, and to report it at this early stage would be a frivolous and a waste of the police time...

if you harm them in any way, although you want to, you will be held acountable by the police and the theifs can press charges against you, not the best idea. Keep this in mind.

Hmmm... i am not the most ethical person i know to start with so if uve got a techncality wiht the insuros then use it (god knows they would). First id get the dosh, nothin feels heavyer than a big wad of $$$ in ur back pocket
Thennn... id have a bit of fun, first lightly smear crab **** on their front door handle (they'll open their door, turn on their light, cook some food turn on the TV turn on their steza ect.)Before they know it its through their house. -Look on another forum on here about a guy tryin to get back at his ex-missus for some more ideas-
But yes some pay back is in order... Ive put a lot of time and effort not to mentin $$$ into restoring my HR and i would not be at all pleased if some disrespectful toss floged it and did the sort of damage i think ur talkin about to it.

All the resposible people on here, i understand what your saying is correct, but would you really have the control to hold yourself back from the sweet nectar of revenge???? the smart thing to do is nothing, report it blah blah blah
But i know if it was my car which i have invested not only money, but hours upon hours upon hours into, not to mention (i know this sounds corny) but as my first descent car it has plenty of sentimental value. If it were me, and i didnt know where they lived, i'd hunt them down till the day i died, and when i found em, lets just say i wouldnt turn them over to the cops, and leave it a that

has the car got nething in it liek cd's mags stezz anything like that if so go pay the car a 3am visit and get it all back and just leave a car on bricks for them to drive
